my father doesn't have pan at the time when bank deducted tds @ 20% On interest. but currently my father has pan and he want to claim refund of tds.
now bank give form 16 a from its software not from traces.
I have filled my father return claiming tds.
can I get the refund or not.
please help

Bank has deducted 20% tds that means they have also filed tds return without PAN of your father. So tds credit will not gone to your father's pan and without checking credit of tds in 26AS if you filed your return then refund will not received by you. but if you ask bank to revised return with your father's pan then refund will be possible.

No you don't have to file rectification. first ask deductor (bank) to revised tds return and before revised return income tax department processed your case without refund intimate. then only you have to file rectification without adding anything just saying reprocess the case. by doing this if bank revised tds return and IT dept. reprocess the case you will be able to received your refund then.
