10 August 2024 For an LLP (Limited Liability Partnership) in Maharashtra, here’s a step-by-step guide on how to file PTRC (Professional Tax Registration Certificate) returns, especially if you did not have any staff for the last two years:

### **1. **Understanding PTRC Requirements**

- **PTRC Registration** is applicable to employers who have employees on their payroll.
- Since you mentioned that your LLP did not have any staff for the last two years, you may not have been required to file PTRC returns during that period.

### **2. **Filing PTRC Returns**

If your LLP had no employees during the period in question, here's how to handle PTRC returns:

#### **A. **Log into the Maharashtra Professional Tax Portal

1. **Access the Portal:**
- Visit the [Maharashtra State Professional Tax Portal](https://mahagst.gov.in).
- Navigate to the "Professional Tax" section and select "PTRC" related services.

2. **Login:**
- Use your PTRC login credentials to access the filing section. If you don’t have credentials, you might need to register or retrieve them from the portal.

#### **B. **File Nil Returns for the Period

1. **Select the Period:**
- Since you had no employees for the last two years, select the appropriate period for which you need to file nil returns.

2. **Enter Details:**
- In the return form, indicate that no salary was paid, and therefore, no professional tax was deducted or paid.

3. **Submit Nil Return:**
- Submit the return as “Nil” for the relevant period. This ensures that your compliance is updated and recorded as per the legal requirements.

#### **C. **Handling Penalties or Compliance Issues

1. **Penalties:**
- If there are any penalties for late filing or non-filing, you should check with the Maharashtra Sales Tax Department or Professional Tax Authority for possible waivers or reductions, especially if you had no staff during the period.

2. **Contact Authorities:**
- For specific issues or clarifications, you can contact the Maharashtra Professional Tax department or consult with a tax professional.

### **3. **Documentation**

- **Records:** Keep a record of your nil returns and any correspondence with the tax authorities for future reference.
- **PTEC Filing:** Ensure that your PTEC (Professional Tax Enrollment Certificate) filings are up to date, as this is separate from PTRC.

### **4. **Future Compliance**

- **Regular Filing:** Once you have employees, ensure regular PTRC filing is done every quarter or as per the applicable schedule.
- **Updates:** Stay updated with any changes in professional tax regulations or filing requirements.

### **Additional Resources**

- **Maharashtra Sales Tax Department**: For direct queries or issues, you can visit their [official website](https://mahagst.gov.in) or contact their support.

- **Consult a Professional**: For more complex issues or to ensure compliance, consulting a tax advisor or professional accountant who is familiar with Maharashtra's tax regulations can be beneficial.

By following these steps, you can ensure that your PTRC return is properly filed and that your LLP remains compliant with Maharashtra's professional tax requirements.
