provision of tds liability & payment

19 May 2010 we are paying professional fees to our employee for the month end to the next month of 10th & accordingly we are making a provision on 9th & we are deducting tds in their professional fees as we are deducting tds on 9th shall we eligibal for tds liability on 7th of next month

19 May 2010 From the facts, the provision and due date is correct.

Just check, whether the payment to your employee is professional fee or liable to TDS under salary.

19 May 2010 No if the payments are being made on 10th and provisions being made on 9th then I dont think your responsibility falls on 7th TDS payment.
But if these amounts are fixed and you know them st the end of month it would be better to deduct the TDS amounts and deposit with the department.


23 May 2010 You are not clear.How professional fee & employee relation ? This can be contractual but again there will be no staff/Employee relationship. This is fine your liablity will be on payment or booking.TDS will be payable by 7th in the next month of provision.
