Procedure for filing the itr by lh

23 March 2012 Can LH cannot file a return for the deceased person without obtaining a digital signature?

For normal assessees,digital signature is an option but an assessee can choose to not obtain the digital sign and send the ITR-V to CPC,B'lore.


I guess there must be an option to file the return of a deceased person by a LH by sending the ITR-V to CPC,B'lore like we do for normal assessees.Please clarify.

I request knowledgeable forum members to respond at the earliest.Thanks for your help.

LH can file ITR V, but if however the deceased was having a Tax Audit in the financial year than you have to file the return with DSC

26 March 2012 Deceased has income from commission and TDS has been deducted u/s 194H. And Sec 44AA and 44AB does not apply on him. Can LH file the return without DSC in this particular case. Kindly suggest..


26 March 2012 Filing of e-return by Legal Heir (LH) using DSC: Revised Process

This is regarding cases where the assessee has expired but a return has to be filed by LH using his DSC. Following process is suggested in above regard :
The legal heir (LR) has to get a DSC in his own name.
LH is required to make a request by sending a mail to ask@incometaxindia.gov.in mentioning the name, PAN,Date-of-Birth of deceased as well as that of the LH along with scanned attachment of the death certificate of the deceased.
On receipt of above, LH would be enabled to file the return of deceased using LH’s DSC.
