28 September 2009 What is the check to find whether the date of Audit report mentioned in the e-filing return is the actual date when e-filing is done after the due date of filing return? this is with reference to the penalty u/s 271B.( Since report in 3CB and 3CD are not physically filed now).

29 September 2009 1. There is no such cross check system. Govt believe on the assessee. If the wrong information is given the penal & prosecution consequences have to face by the assessee.
2. Govt also do not know how much and where you have made the investment under section 80C. It does not ask to enclose the LIP, NSC,PPF etc. Govt has shown faith on the assessee.
But if the case is pickedup for scrutiny then the assessee has to submit all such documents before the A.O.
