Penalty on non filing of tds return which has nil liability

Coming first time to this situation where TDS return has not been filed by a company which has no liability towards TDS for the related quarter.

Whether penalty of Rs. 200/- per day would be applicable to this ?

11 January 2013 yes , as said in union budget its now mandatory fees for this act. of 200Rs. per day.........
