We had provided services to one of our client when stax rate was 12.36, He paid us service tax rate @ 10.3 by giving me explanation that service tax liability arises at receipt basis & rate is also the effective rate at the time of receipt i.e 10.3 What is your suggetion to my client

rate is applied when the service is provided. It has been decided recently in the case of reliance industries. U can also refer st-3 , where old rates are mentioned i.e, tax to be paid @ old rates but at the time of collection.
