Partial reverse charge mechanism

15 April 2013 Whether a Society registered under Societies Registration Act will be treated as Body Corporate under Companies Act 1956 for the purpose of Partial Reverse charge mechanism.

15 April 2013 as per rule 2(bc) of the STR,1994
Body Corporate has the meaning assigned to it under section 2(7) of the companies act, 1956.
NOW AS PER SECTION 2(7).
Section 2(7) in The Companies Act, 1956
" body corporate" or" corporation' includes a company incorporated outside India but 1[ DOES NOT include-
(a) a corporation sole;
(b) a co- operative society registered under any law relating to co- operative societies; and
(c) any other body corporate (not being a company as defined in this Act) which the Central Government may, by notification in the Official Gazette, specify in this behalf;]
