I have been working with a private company since Oct 2012. I worked for the company in Dec as well as Jan but have not received salary for the same yet. Earlier my MD was making excuses to make salary payment as he got involved in some Legal issues. Though he is free from all those issues now he is still not releasing employees salary.
Payment of two months salary is due. I wanted to know what actions I can take against him.
I am having company's cheque book for safety purpose wherein my dec 2012 salary's cheque is made and signed by MD. Can I deposite the cheque in bank without permission of MD? will be it under professional ethics? Or what else I can do againts him?
What i assume that you can send a legal notice for recovery of salary or you may lodge complain in labour welfare for non receipt of salary.
If no response is received from company after serving notice you may deposit chq, however it is not advisable since you have obtain custody without permission so they can make fraud case or till now this chq might have stopped for making payment.
