Owner/Lessor resides at Delhi and his/her property even at Delhi.

Tenant/Lessee from hyderabad took the Delhi premise for rent

Here, which Non-Judicial stamp paper will be used., Delhi or Hyderabad

23 June 2015 Place of execution of documents will decide the use non-judicial stamp papers.

As the property is located at Delhi, it is advisable to enter the lease agreement at Delhi and pay the stamp duty, registration fee etc. as per Delhi state rules. Delhi is always preferable for concessional rates of many state levies.

Any adverse legal implication is there if the NJ stamp paper is belongs other than delhi, that is of AP where the Lessee actually belongs


24 June 2015 If you are not going register the same with Delhi registration authorities and keeping the agreement only for a formality sake, then even without stamp paper as well has same value vis-a-vis AP stamp paper.

Also check whether requirements of registration for execution of a lease agreement in Delhi. In case of AP it is mandatory irrespective of value, term etc. to admit the same as evidence in court of law in case of any dispute.

A lease agreement to be executed and registered as per laws to protect the interests of the lessor. In case of any dispute, the lessor without proper legal right, would suffer more than that of a lessee.
