Non - filing of returns

Does a TRO has power to issue a letter to the assessee to file returns for A.Y.: 2009-10, 10-11 and 11-12. The assessee has filed returns from A.Y. 2012-13 onward.

Can he just issue a letter calling for returns without mentioning the provisions of section contravened??
