Non Allowance of Teansfer

17 June 2016 Sir I resigned from my firm more than a month ago. They called me for a meeting 10 days ago and post that have made me sit at home. They are not allowing me transfer and to top of it are debiting my leaves so that i rejoin the firm. They are giving no responses to mails and verbal follow up. What steps can I take to get my transfer knowing that my firm's partner is a very senior and influential person at ICAI too. Will I be able to get justice.

17 June 2016 What was the reason for your resignation. Did you not sit with your Principal before deciding to resign from the firm ? If you are reasons are genuine / valid and in accordance with CA regulations you can approach ICAI and put forth your case before them. Many times it is better to go for an amicable solution on matters that can be discussed by sitting across the table.

17 June 2016 Sir, the reason was the non interest in the field in which I was offered articleship. I could not develop an interest in it and don't think it is wise enough to be working for 3 years in the line I don't want to pursue my career in. Yes, I did have a meeting with my principal to discuss the matter and I was asked to sit at home till the time management takes a decision. Its over 10 days now and there have been no responses from them even on a daily follow. It is this firm's usual practice to not give transfers easily and articles are made to sit at home. They always take more than a month to give a transfer as known from the previous cases. Sir, I would really grateful of you enlighten me on how to approach ICAI and approach further.


17 June 2016 You did not do a due diligence about the firm where you would be bonded for three years from your seniors or other contacts or during the time of your interview ? Anyways, now that is past but there are no straight jacket approaches to resolve any issue. You got to have patience in waiting to get a response from the firm, they may be dilly dallying for reasons better known to them. You can think of keeping yourself engaged in a prospective firm where you wanted to continue your article training, as I presume before resigning you would have thought about the next move. It is an administrative process that is left to be initiated from your present and prospective employer, upon you getting relieved from there.

You have to chase or go to people plead them to get you out from the present firm without complicating matters any further. Patience is important tool that you must imbibe as a quality in you. Wait for some time and then decide of your next moves.
