New company incorporation

06 January 2012 I AM IN PROCESS OF INCORPORATING A PVT. LTD COMPANY AND RECENTLY RECEIVED A MAIL FROM MCA THAT THE NAME OF THE PROPOSED COMPANY WHICH IS UNDER PROCESS OF INCORPORATION IS DECEPTIVELY RESEMBLING TO THE EXISTING REGISTERED TRADE MARK AND ACCORDINGLY MCA ASK US TO FILE FORM 67 AS ADDENDUM FOR RECTIFICATION OF DEFECTS OR INCOMPLETENESS.
I AM DISAPPOINTED THAT HOW AFTER GETTING NAME APPROVAL FROM THE MCA ABOVE DEFECTS ARISE.
PLS ADVISE ME WHAT STEP I NEED TO TAKE.

MCA has recently started on its site from where you can check whether the name is already registered by someone and has taken the trademark on the given name or not.this is the link of the same http://124.124.193.245/tmrpublicsearch/frmmain.aspx

If your name is altready registered by some one then you need to see that whther the objects of your company and the other company are same of different.
If Objects are same then you will not be able to get the same name from the Ministry, but on the other hand, if the existing company is in some another buiness then in Form 67 you can attach a letter which sould be signed by the prospective director/ applicant that the said name which is registered under trademark is doing some another business and hence we are not affecting their business, also it is preferred that you should take a screen shot of that page which can verify your statement.
