How is the criteria of “Value of Consignment of Goods” applied?
Ans: Value of consignment of Goods” is interpreted as follows: 1. Invoice Value* exceeds Rs. 50,000 OR 2. If a vehicle carries goods against multiple Invoices, then where the aggregate Invoice value* exceed Rs. 50,000 So, if either of above points is satisfied, the user should generate e-Way Bill. *Invoice Value means transaction value as per Invoice inclusive of all the taxes excluding the Value of exempt goods that are being carried along the taxable goods and billed together.

Is above scenario is possible?

Thank you.

03 August 2024 Under GST regulations in India, the requirement for an e-way bill is generally determined by the aggregate value of the consignment of goods being transported. Here's how it works based on the criteria you've mentioned:

### **Criteria for E-Way Bill Generation**

1. **Single Invoice Value**: If the value of a single invoice exceeds ₹50,000, an e-way bill must be generated.

2. **Aggregate Invoice Value**: If multiple invoices are being transported in a single vehicle and the total aggregate value of these invoices exceeds ₹50,000, an e-way bill must be generated.

### **Scenario Analysis**

1. **Multiple Invoices with Value Below ₹50,000**:

- **If the Invoice Value is Below ₹50,000 Each**:
- If you are generating multiple invoices for a single firm on a single day, and each invoice value is below ₹50,000, you do not need to generate an e-way bill for each invoice individually.
- However, if the total aggregate value of all invoices being transported together in a single vehicle exceeds ₹50,000, an e-way bill is required.

2. **Generating Invoices for Different Vehicles**:

- **Different Vehicles for Invoices Below ₹50,000 Each**:
- If you are using different vehicles and each vehicle is carrying invoices with values below ₹50,000, you don’t need to generate an e-way bill as long as each vehicle's load does not exceed ₹50,000.
- If the total value of invoices in any single vehicle exceeds ₹50,000, an e-way bill is required for that vehicle.

### **Regulations and Compliance**

According to the GST rules:

- **Rule 138 of CGST Rules**: Mandates the generation of an e-way bill when the value of the consignment of goods exceeds ₹50,000, whether under a single invoice or multiple invoices for the same vehicle.

- **Practical Application**:
- If the invoices are aggregated and the total value exceeds ₹50,000, an e-way bill must be generated for the entire consignment.
- If the consignment is split across different vehicles, each vehicle’s consignment must be individually assessed. An e-way bill is required for each vehicle if the value of goods in any one vehicle exceeds ₹50,000.

### **Example**:

- **Example 1**: You have 3 invoices of ₹40,000 each being transported in a single vehicle. Since the total value is ₹120,000 (which is above ₹50,000), an e-way bill is required for the vehicle.

- **Example 2**: You have 2 invoices, one of ₹45,000 and one of ₹30,000, each being transported in different vehicles. Since neither vehicle’s consignment exceeds ₹50,000, no e-way bill is required for either vehicle.

### **Actionable Steps**:

1. **Verify the Total Value**: Ensure that you aggregate the value of all invoices being transported in a single vehicle. If this total exceeds ₹50,000, generate an e-way bill.

2. **Separate Vehicles**: If using separate vehicles, check the total value of the goods in each vehicle. Generate an e-way bill if the value in any vehicle exceeds ₹50,000.

3. **Documentation**: Maintain proper documentation for all invoices and ensure that e-way bills are correctly generated where required.

In summary, whether or not you need to generate an e-way bill depends on the total value of the consignment being transported. The criteria provided ensure compliance with the regulations to avoid penalties and ensure smooth logistics operations.
