Mistake in audit report

The details in 3CD report while mentioning the TDS annexure there was mistake on the part of the Auditor

On this basis case was re-open by the ITO stating TDS amount in Audit report is more than Actual amount Paid what is the remedy available to save the Case...?

Is there can court judgement kindly provide the same

23 November 2012 oh there is no remedy if audit report gives false information.

if return of income provide false information or misstatment then remedy is available.

refer case law price water house coopers pvt. ltd. v/s commi. of income tax and another(2012) 77 D.T.R.(S.C.)153

in your case auditor will be liable for professional misconduct and you can sue on auditor for monetary harm.
