I am student of CA Final New Course and took excess leave during the articleship. and now i am completing my extention. now i want to know whether any leave are alowed to me during such period or not??
If u r re-registered for setting off the excess leaves already taken in original articleship period, it means that the balance days to be served are the days of excess leaves and in latter case u took extra leaves (other than sundays) it means that u r extending it further.... u can take excess leaves its impact is only extension of articleship, nothing else. it is advised not to take extra leaves (though u can) as they will further extend ur articleship....
But as per institutes leaves calculation they calculate the extension period on the basis of actual days served during the articleship. i.e. (total period served minus leaves taken)/ six. then reduce the leaves eligible from the leaves taken. then why should we are not eligible for the leaves during such period of extension.
for me the case is as under Total period served 1278 days leaves taken 421 days which they reduced from the period (1278-421) 857 days my eligible leaves are 143days (857/6) and my extension period is 278 days (421-143).
Then why i am not eligible for the leaves during the extension period.
listen brother, institute is very extra advanced in these cases, assume leave taken x days so as per institute rules u can have a maximum number of leaves only to 180 days so the equation goes like this -
(1278-x)/6 = 180
where, (1278-x) is actual period served, 1/6 are eligible leaves and it can't exceed 180 so maximum no is 180.
solving x we get, x=198, but as stated in the rules leaves cannot exceed 180 days.
In simple words to answer ur quarry again i m stating that ur extension is done due to the fact u had taken excess leaves in regard to maximum available and u r serving the extension to cover up ur original leaves taken during the articleship, in the period of extension if u wil take excess leaves u wil be simply extending ur period more to the days u tkae leaves. no calculations are required in the case of extension for eligible leaves as the concept of eligibility does not apply here.
