Leave Entitlement

29 December 2008 Dear Sir,

Please clarify whether we have to work for paid leave in excess of 1/6th entitlement or just all the leave taken. i have not been paid for 7 months leave and my boss considers them as leave and tells me to work.. my articles get completed on 31st march but he says he'll releive me only by october. its very urgent pleaaase clarify.

30 December 2008 You are eligible for 1/7th of articleship period. i.e. 138 days as leave. If you have taken 210 days then 210-138 = 72 days excess leave. In this case you have to work 62 days extra or accordingly work extra days like on holidays and lessen the burden. You can also work later as per mutual understanding. All 210 days leave is not treated as extension. Also for extension if you are not paid before then you are paid then. Also for the 138 days you are eligible for stipend.
