This query is : Resolved

17 March 2021 Hi All

Can J1 and J2 be updated for FY 2014-15 to FY 2017-18-TIN for customers now in FY 20-21?

Thanks in advance.

09 July 2024 As of the information currently available and the standard procedures followed by tax authorities in India, updating J1 and J2 forms for the periods FY 2014-15 to FY 2017-18 in FY 2020-21 might be challenging. The ability to revise these forms typically depends on the specific guidelines and deadlines set by the tax authorities, and these periods generally have stringent revision windows.

### Steps to Consider for Updating J1 and J2 Forms:

1. **Check Revision Deadlines**: Verify if the tax department has provided any extension or special provisions for revising returns for these periods. This information can typically be found on the official state VAT portal or through notifications issued by the tax department.

2. **Consult with Tax Authorities**: Directly contact the local tax office or the helpline provided by the tax authorities to inquire if revisions for these periods are still permissible.

3. **File a Rectification Request**: If the standard revision window has passed, you might be able to file a rectification request or an appeal for the specific periods, explaining the reasons for the revision and providing necessary documentation.

4. **Professional Advice**: Consulting with a tax professional or a chartered accountant who is well-versed in state VAT laws and procedures can provide clarity and guidance on the best course of action.

5. **Review of Statutes and Notifications**: Carefully review any state-specific VAT laws, statutes, or notifications that may provide exceptions or detailed procedures for filing revisions after the typical deadlines.

### Scenario and General Guidelines:

- **Standard Revision Window**: Typically, VAT returns including forms J1 and J2 have specific deadlines within which they must be filed or revised. These deadlines are generally within the same financial year or shortly thereafter.

- **Exception Handling**: In some cases, if there were significant errors or omissions, tax authorities may allow revisions or rectifications through formal requests or appeals.

- **Penalties and Interest**: Be prepared for potential penalties or interest that may be levied due to late filings or revisions.

### Example Scenario:

If the state VAT authorities have provided an extension or a specific scheme to rectify or update older returns, it would be mentioned in their official communications. For example, during the transition to GST, some states provided specific time windows to update and rectify older VAT returns.

### Key Takeaway:

The feasibility of updating J1 and J2 forms for the years depends on the specific guidelines and provisions provided by the state VAT authorities. It is crucial to stay informed through official channels and seek professional advice for the most accurate and timely course of action.
