My query is a person has switched in 3 companies in FY10-11. He has form 16 of the first two company. The third company which was joined on mid feb has paid salary of 90,000 had not deducted any tax and hence no Form 16 issued by it.
Now, he doesnt want to show details of third company and salary of Rs. 90000 in return.(by doin this escape self assessment tax payable 5000)and it will be a case of refund of rs 4000. Is it advisable?

No, it is not advisable as Form 16 is issued by the Company they might have shown you as deductee in TDS return, and hence details of your salary will be reflected in AIR returns and can be cross checked by IT Dept

thanx for help..but as i said third company has not deducted tax and no form 16 is issued by it. so in their TDS return he will not be shown as deductee.

In the verification part of the return, assessee is declaring that it is a true and correct return. If the assesee is filing the return by not including the salary form the third employer,though there is no TDS and form 16, the aforesaid declaration becomes false which may lead upto prosecution if wilful ommission is detected by the IT department.
