I had filed ITR-3 on the option of Non-Account Case by showing therein Gross Receipt of brokerage and commission, gross profit, expenses and net profit but the income tax department has treated the ITR-3 as defective return with the memo of disallowances/ defects identified in the income tax return. Please guide me sir and oblige.

As it is 100% proprietary concern, I had filed ITR-3 on the option of Non-Account Case.The gross receipt was Rs. 5,50,000. Since the income was received from partnership firm, I had not filed ITR-5. Hope u will please guide me and oblige.

ITR 5 is filed by partnership firms and not partners having partnership income please take a note of the same. May the department wants you to file profit and loss and not go with non account case as you have filled you ITR with expenses and all. You can refer you notice received u/s 139-9 there the department mentions the reason of defect or you can call up CPC or jurisdictional officer for clarity as without seeing the copy of notice and xml filed by you it is little difficult to give you exact answer.
