is it compulory to register partnership deed for upvat

24 April 2010 hi friends,

i have a client having business under partnership firm but there is a issue with upvat authorities regarding its deed, as per department registered partnership deed is compulsory but in our opinion it is complsory under partnership act 1932.when we go for registration under partnership act then only registered deed is required.
so please reply as soon as possible.

As per the provisions of Indian Partnership Act 1932, Registration is Voluntary & It is not Mandatory irrespective of the fact that registerd firms will enjoy few benifits which are not available for unregistered firms.

In practice, in many circumstances other legal regulations requires registration certificate of the firm, it may be VAT, Institutional Funding etc.

In the long run prospective it is advisable to opt for the registration of the firm.
