Income tax refund returned undelivered.

17 February 2012 Dear sir,
My refund cheque was returned undelivered by postal department on May 2011 for AY 2010-11.
Therefore, in Sep. 2011, I have made a request letter to re-issue cheque at local IT office (as return was filed manually, but cheque was issued by refund banker.).
Still, I have not received my refund cheque.
Please advise me.

18 February 2012 If it is off line filing he has to approach local assessing officer for refund process. For that he has to submit a wriiten document to the department about the fact and mention his current residential address along with bank details.

18 February 2012 I already have moved an application to re-issue my refund cheque, enclosing the copy of web page of refund status, on Sep. 2011. Till date result is none.


18 February 2012 Second course of action may be as follows:
In view of several CPIO's (assessing officers) of the IT Department denying information under some sections of the RTI Act, attached is the new format for RTI Application for pending IT refunds.

1. The RTI Application has to be addressed to the CPIO, who is the same as your assessing officer (ITO/AC) of your ward/circle where you filed your IT return, in which you claimed refund.
2. File separate RTI applications for different years - one application for each year
3. As per the "Citizens Charter" of the IT Department, they normally take 9 months to process and give refunds, as counted from the end of the month in which you submitted your return. There is no point in filing a RTI Application before nine months are over.
4. The Name and Address of the CPIO (assessing officer) can be obtained from:

Please scroll down to the bottom of the page, select the State and hit the "Go" button.

Once a new page opens, click on the CPIO/CAPIO tab (blue colour) available at the top of the page.
5. The IPO for Rs. 10.00 can be purchased from the nearest Post Office.
6. For guidance on how to submit your RTI Application, please read: How to submit a RTI Application - RTI Guide
7. The PIO has 30 days from the date he receives your RTI Application, to provide you the information.
Add another 5 or 10 days for postal delays.
8. If you do not get a reply from the PIO within 40 to 45 days from sending the RTI Application, it can be safely assumed that the PIO is not going to reply and provide you the information you sought.
This can be termed as "Deemed Denial" of information.
In such a case, immediately file a First Appeal for "deemed denial" of information.
9. The format for such a First Appeal is also attached to this post.
10. Details of the First Appellate Authority (FAA) can be obtained from the same website, from which you obtained the details of the CPIO. Generally, it is the Joint Commissioner or Chief Commissioner, of that particular Range to which your ward/circle belongs.
11. The First Appeal has to be filed within 60 days of the date of your RTI Application.

19 February 2012 First of all, RTI is just for providing information, it will not solve the problem.

In case of door lock, Income tax Refund cheque issued by CPC Bangalore returned back for non-delivery and therefore you need to send a request letter to CPC Bangalore at below address:
“Income Tax Department – CPC, Post Bag No – 1, Electronic City Post Office, Bangalore – 560100, Karnataka”

You need to mention the reason for return of cheque and in case of change in address you need to send "address/bank-details modification form (Response Sheet)along with the letter with proof of new address.

To Download the Response Sheet Assessee need to take Following steps:-

1. Visit https://incometaxindiaefiling.gov.in/portal/index.do

2. Enter login details.

3. After login go to sub menu ‘Response Sheet For Refund Failure Status‘ under the main menu ‘My Account’

4. Download the response sheet.

19 February 2012 If the cheque is not received at the address, a not-delivered-slip is given. The post-office nearby keeps the packet for 4 to 5 days, and you can collect personally by taking the not-delivered-slip and your co. stamp (preferably between 9.30 and 11 am, and sometimes till 12 pm, separate counter handles these cases)
