Income Tax Exemption under 80G

20 January 2010 Dear Sir,

I would like to get clarfified my doubt regarding tax exmeption under 80 G.

Case:

I paid a sum of Rs. 15,000 towards a trust. dated my checque on 09.02.09.

I have received the Receipt from the trust dated 19.03.2009 for the same. This receipt I received sometimes in the first fortnight of April 2009.

It is obvious that I could not produce it towards saving for the year ending March 09. I also could not claim it in my ITR.

Now I want to claim the benefit this year. My Employer is saying that it is not possible as the date of the receipt is for the last year.

On the contrary, the receipt says that it is valid from 01.04.2008 to 31.03.2011.

Can any expert suggest me,,, if can i claim it as saving under 80G this year (Apr2009-March2010).

Or is there any other way to get the exemption benefit of this donation.

Pls reply soon..

As most of the employer gives the period of Jan & Feb only for any such proof productiion for savings...

20 January 2010 I understand from the query that the date of payment/receipt date falls in financial year 2008-09. So 80G exemption had to be claimed in that year. Now only solution I find is revise the return already filed through which avail the deduction. In other words it can't be claimed for financial year 2009-10.

The Payment was made by you in the last year itself, hence you cant able to claim for exemption in this year.If you have filed your returns with in the due date then you can make the revised return for claimimg the deduction for the Previous year.

and to clerify you about your doubt regarding "the receipt says that it is valid from 01.04.2008 to 31.03.2011" it is not for receipt but 80G benifit is valid for donation given during these period.

20 January 2010 First of all which I understand you are talking about TDS because when I see all the facts you provided shows as employer requires proof of investment in Jan or Feb. Then I want to tell you if you had been provided this receipt than also employers can't give you deduction in TDS as for TDS 80G can't be considered.
Now if you have filed your return u/s 139(1) without considering 80G then you can revise return and this will be available to you there is no problem in that.
