This query is : Resolved

03 May 2011 I have not provided Rent receipts to Employer for HRA Calculation, therefore employer deducted TDS from my salary, please advise can i Claim HRA exempt at the time of filing my ITR. what is the process for claiming HRA Exemption if HRA is shown taxable in Form 16.

03 May 2011 YOU NEED TO PROVIDE HOUSE RENT SLIP TO UR EMPLOYER,

OTHERWISE U CANNOT TAKE THE BENEFIT OF HRA

03 May 2011 Employer ahs done right by deducting TDS in the absence of rent receipts. But u can claim HRA at the time of filing ur return and claim the refund for the excess TDS deducted. There is no provision in law that if u didnt provide rent receipts to employer then u cant claim HRA. So go ahead and claim HRA in ur return.
