30 June 2017 If you don't have any branch office or other place of business in other states then there is no need to take registration in other states even if other registrations under other laws (i.e labour law in your case) is obtained.

30 June 2017 Our company is into contractual staffing & we have employees on our payroll PAN India. But invoicing is done from Mumbai office only.

27 July 2024 In the context of GST (Goods and Services Tax) registration, the requirement depends on the nature of your business operations, the locations where you conduct business, and where your services are provided. Here's a detailed overview based on your situation:

### **1. GST Registration Requirements**

**1. **General Requirement:**

- **Threshold Limit:** Under GST, businesses must obtain registration if their aggregate turnover exceeds the prescribed threshold limit, which varies depending on the type of supply and the state.
- **Interstate Supply:** If your business makes taxable supplies of goods or services across state borders, GST registration is mandatory irrespective of turnover. This applies even if you don't have a physical office or presence in the states where your employees are located.

**2. **For Contractual Staffing:**

- **Service Provider:** As a business providing contractual staffing services, you are considered a service provider. GST registration is required if you provide services across state boundaries or if your turnover exceeds the threshold limit.

- **No Physical Presence:** Even if you don't have a physical office or presence in other states where your employees are located, GST registration in the state where you are providing the services is necessary. This is because GST is applicable based on the place of supply and the nature of the supply.

**3. **Invoicing from Mumbai Office:**

- **Centralized Registration:** If your only office is in Mumbai, you can opt for a centralized GST registration for all services provided across India. However, if you are providing services in multiple states and have employees working there, you should consider obtaining GST registration in each state where the supply is considered to occur.

### **2. **Types of GST Registration**

- **Single State Registration:** If you are only invoicing from Mumbai and all your operations are centralized, you may opt for a single state registration. However, this is only feasible if you are not providing services across state lines or if your activities do not necessitate multiple state registrations.

- **Multiple State Registration:** If your business operates in various states, even without physical offices, you might need to obtain GST registration in each state where you are providing services. This is especially important for compliance with state-specific GST laws.

### **3. **Considerations for Compliance**

- **Place of Supply:** Ensure you understand the place of supply rules under GST. For staffing services, the place of supply is typically where the service is provided or where the recipient is located.

- **Invoicing and Documentation:** Ensure proper invoicing, documentation, and compliance with GST laws, including filing returns and maintaining records. This is crucial regardless of where the office is located.

- **Consult a GST Consultant:** Given the complexity of GST laws and regulations, especially concerning interstate operations and staffing services, consulting a GST advisor or tax consultant can help ensure compliance and optimize your GST strategy.

### **4. **Labour Law Registrations**

- **Labour Laws vs. GST:** Labour law registrations (such as PF, ESI, etc.) are separate from GST requirements. While labour law compliance is essential for operating your business legally, it does not substitute for GST registration if you are liable under GST laws.

### **Summary**

Given that your company provides contractual staffing services across various states but invoices from Mumbai, you should:

- Assess if your turnover exceeds the GST threshold limit.
- Determine if you need GST registration in states where you provide services.
- Opt for centralized or multiple state registrations based on your business model and compliance requirements.

To ensure accurate compliance, consult with a GST consultant to navigate the requirements specific to your business and operations.
