27 July 2024 When purchasing an industrial shed and dealing with GST, here are the key points you need to consider:

### **1. GST on Purchase of Industrial Shed**

**A. **GST Rate on Industrial Shed:**

- **GST Rate:** The sale of an industrial shed is typically subject to GST at 18% under the category of "Construction Services" or "Works Contract" depending on the specifics of the transaction.

**B. **Input Tax Credit (ITC) Eligibility:**

- **Claiming ITC:** Generally, you can claim Input Tax Credit (ITC) on GST paid for inputs used in the course of your business. This includes GST paid on the purchase of industrial sheds, provided the industrial shed is used for making taxable supplies.

### **2. Applicability of Input Tax Credit (ITC)**

**A. **ITC Eligibility Criteria:**

- **Taxable Supplies:** If you are using the industrial shed for making taxable supplies, you are eligible to claim ITC on the GST paid on the purchase of the shed. The ITC can be used to offset your output tax liability.

- **Exempt Supplies:** If the industrial shed is used exclusively for making exempt supplies, you would not be eligible to claim ITC on the GST paid for its purchase.

**B. **Provisions Under GST:**

- **Section 16 of CGST Act:** Under Section 16 of the CGST Act, a registered person is entitled to claim ITC on the tax paid on purchases used in the course of business, subject to certain conditions.

- **Rule 143:** Refers to specific rules related to the use of inputs for taxable and exempt supplies. If your supplies are taxable, you are eligible for ITC on inputs, including capital goods like an industrial shed.

### **3. Practical Steps for ITC Claim**

1. **Ensure Usage for Taxable Supplies:** Verify that the industrial shed will be used for making taxable supplies. This includes manufacturing, trading, or any business activity that attracts GST.

2. **Maintain Documentation:** Ensure that you have proper documentation including the tax invoice for the purchase of the industrial shed. The invoice should clearly show the GST charged.

3. **File GST Returns:** Claim the ITC while filing your GST returns. Ensure to reflect the purchase and input credit appropriately in your GST returns.

4. **Consult Professional:** If there are complexities or uncertainties, consulting with a GST professional or tax advisor is advisable to ensure compliance and correct ITC claims.

### **Summary**

- **GST on Purchase:** GST at 18% is applicable on the purchase of an industrial shed, if classified under construction services.
- **ITC Eligibility:** You can claim ITC on GST paid for the purchase of the industrial shed if it is used for making taxable supplies.
- **Exempt Supplies:** If the shed is used for exempt supplies, ITC cannot be claimed.

Ensure that the purchase and use of the industrial shed align with GST regulations to claim the ITC correctly. Consulting with a GST advisor will help in handling any specific scenarios or compliance issues.
