Gratuity payment

01 August 2011 if employee leave before 3 months of completing his 5 year tenure, did employer have to pay gratuity to him? I read that if employee's completed years are more than 5 then only he have to pay gratuity and it it is more than 6 months after 5 year it should be rounded to next completed year., is the same logic applies if he did not complete his 5 years?

01 August 2011 as per section 2(b) of the Payment of Gratuity Act, completed year of service means continuous service for one year. so one year means 12 calender month. so need to complete 5 completed years for eligible for gratuity
