Hi, does the definition of a company include a government company. Section 125 of the companies act 1956 is applicable to a company, does that mean it is applicable to a government company as well. Pls reply asap.

AS per section 2(18) of the Companies Act,1956 'Government Company' means a Government company within the meaning of Section 617 of the Act. In Bare Act u can read 'Application of Act to the Government Companies'. In my opinion sec.125 is not applicable on govt.companies.

In my opinion, A Government company is also a company under the act even if it is not registered under the act.
Though the definition specifically define private & public company, In the Act at various places the word" company" is used, without any prefix or suffix, it would mean that the provision applies to all kind of companies.
