In our organisation we had few people who joined the organisation between the financial year, we deducted TDS based on form 12B submitted by them, i.e taxable income as well as TDS deducted by previous employer. now the question is based on form 12b can we issued form 16 combined for full one year i.e previous employer as well as our payments. what are the consequenses.

Dear Manoj, NO YOU CAN NOT ISSUE FORM 16 COMBINED FOR FULL YEAR. you can issue form 16 only for that period in which he worked in your organisation and for the rest period form 16 will be issue by previous employer. In your Form 16 you can show his salary of your organisation and if he is claiming any other income before 15th Jan of that FY on which TDS is not deducted than you can show that amount after deducting TDS. But as you say TDS is deducted by previous employer than you can not show that income in your Form 16. I think it is clear now.
