When submitting Form 112 along with a Condonation Letter and an Observation from your Chartered Accountant (CA), here’s how you should proceed:
1. **Condonation Letter from CA**: - The Condonation Letter should indeed be on the letterhead of your CA. It should be a formal letter addressed to the Institute of Chartered Accountants of India (ICAI), explaining the reasons for the delay or any other issue for which you are seeking condonation. - The letter should clearly state your details (name, membership number if applicable), the reason for the delay or issue, and a request for condonation. It should be signed by your CA.
2. **Observation Letter from CA**: - The Observation Letter is typically a separate document that your CA provides alongside the Condonation Letter. It should also be on the CA's letterhead. - The content of the Observation Letter should include: - Confirmation that they are your CA and are aware of the matter related to Form 112. - Details of their observations regarding your situation, such as the reason for delay (if applicable) and any relevant circumstances. - Statement of support or clarification regarding your submission of Form 112 and any additional context that might assist the Institute in considering your application.
3. **Formatting and Details**: - Both letters should be professional in tone and clearly written. - Ensure that all details requested by the Institute are included and that the letters are signed and dated by your CA. - The Condonation Letter focuses on seeking forgiveness or understanding for any procedural lapses or delays. - The Observation Letter provides additional context or clarifications that support your application.
By following these guidelines, you can prepare the necessary documents (Condonation Letter and Observation Letter) to accompany your Form 112 submission effectively. This ensures compliance with the Institute's requirements and enhances the likelihood of a smooth processing of your application.
