24 July 2024 If you have completed your articleship on 15th March 2011 and have taken 4 months of excess leave, here are the considerations regarding serving the excess period under another principal and its impact on your attempt in November 2011:

### Serving Excess Period Under Another Principal:

1. **Transfer of Articleship**: According to the guidelines of the Institute of Chartered Accountants of India (ICAI), you can serve the excess period under another principal. This requires formal approval from both your current principal and the new principal.

2. **Procedure for Transfer**: You need to initiate the transfer process by obtaining consent from your current principal and the prospective new principal. The transfer process involves completing Form 109 and submitting it to the ICAI for approval.

3. **Timing**: Since your attempt is in November 2011, you need to consider the following:
- **Examination Eligibility**: You are eligible to appear for the CA final examination during the last 6 months of your articleship. This means you can sit for the exams starting from 16th September 2011 onwards.
- **Excess Period**: You can commence serving the excess period after your exams in November 2011, provided you have the necessary approvals for transfer of articleship.

### Impact on Examination Attempt:

- **Exam Preparation**: Serving the excess period after your exams in November 2011 should not directly affect your attempt if you have completed your required training period and fulfilled other eligibility criteria before the exam period.
- **Timing of Completion**: Ensure that the excess period under the new principal allows you to complete all necessary requirements (including a minimum period of 2.5 years of practical training) well before the examination commencement.

### Steps to Take:

1. **Seek Approval**: Initiate the transfer process by obtaining consent from your current principal and the new principal.

2. **Submit Form 109**: Fill out Form 109 for transfer of articleship and submit it to the ICAI along with the required documents and fees.

3. **Ensure Compliance**: Follow up with the ICAI to ensure that your transfer is processed in a timely manner and that you receive approval before commencing the excess period under the new principal.

4. **Exam Eligibility**: Check your eligibility to appear for the November 2011 exams based on your completion of articleship requirements and other exam-related criteria.

### Conclusion:

It is crucial to adhere to the ICAI guidelines regarding transfer of articleship and examination eligibility. Starting the excess period after your November 2011 exams should be feasible, provided you obtain the necessary approvals and ensure compliance with all requirements. If you have any specific concerns or require further clarification, it is advisable to contact your principal or the ICAI for detailed guidance tailored to your situation.
