I wanted to ask whether excess leave taken from the office is elegible for set off to the extent of excess hours worked in the office.
I m working 5 days a week 8 hours daily which makes it 40 hours. and as per institute's rule 35 hours per week are sufficient. so can I claim these 5 hours excess per week served against my excess leave taken? So that I can reduce my supplementory articleship. Please reply.

You can.............BUT NOT OFFICIALLY.
AND what is UNOFFICIAL is not accepted in ICAI.
Actually this depends on the understanding between you and your principal.If he can ignor few of your leave periods considering your excess work.
Practically 40 hours is not considered as excess hours, as in this profession you will see your seniors and Principal are working latenight sometimes (specifiacally during Finalization, Tax Computaion and Filling, and other Schedule based tasks)
So you can expect a good understanding and relation with your Principal can help you in this regard.

If you realy have worked during audit days or return filing days for extra time, then you can adjust it with excess leaves, this is even allowed by ICAI. But, for normal days, it is not available
