21 July 2024 For understanding the applicability of ESIC (Employees' State Insurance Corporation) to trusts or hospitals in Maharashtra for the year 2010-11, let's clarify the conditions under which ESIC applies to such entities:

### ESIC Applicability for Trusts/Hospitals:

1. **Employee Threshold**: ESIC becomes applicable if an entity employs 10 or more employees. This includes all types of employees, whether permanent, temporary, or contractual.

2. **Salary Threshold**: For ESIC applicability based on salary:
- Employees earning wages/salary up to Rs. 15,000 per month are covered under ESIC.
- Employees earning above Rs. 15,000 per month are exempt from ESIC contributions.

### Specific Details for Maharashtra (2010-11):

For the year 2010-11 in Maharashtra, the applicability criteria remain the same as outlined above. Here are additional considerations:

- **ESIC Registration**: If a trust or hospital in Maharashtra had 10 or more employees during the specified period and any of these employees earned up to Rs. 15,000 per month, the trust/hospital would be required to register under ESIC.

- **Monthly Contributions**: Once registered, monthly contributions (employee and employer share) must be remitted to ESIC based on the wages/salaries of employees covered under the scheme.

- **Compliance**: It's crucial to ensure compliance with ESIC regulations regarding registration, monthly contributions, filing of returns (Form 5 for monthly and Form 6 for half-yearly), and any other requirements mandated by ESIC authorities.

### Consultation and Verification:

For precise applicability details and compliance requirements specific to trusts or hospitals in Maharashtra during the year 2010-11, it's recommended to:

- Consult with a qualified chartered accountant or a legal advisor specializing in labor laws and ESIC compliance.
- Verify the specific rules and thresholds applicable during the specified period, as regulations may have evolved over time.

By adhering to ESIC regulations and seeking expert guidance, trusts or hospitals can ensure compliance with statutory requirements related to employees' welfare and healthcare benefits under ESIC.
