21 September 2012 we are corporate ,we have appoint 20 marketing people as marketing contractor and provide business auxiliary service they are raise separate marketing expenses bill and we deduct tds and anthor side appoint 3 director and 7 office staff. in which 3 director are sitting full time .


My query is whether esi & Pf applicable or not

its urgent

21 September 2012 Yes, Its Get Applicable when you keep employee more that 20 or 20.
and applies for forever.
even you employee get reduced.

21 September 2012 if the contract employee are appointed through a man power agency where ESI/PF liabilities are met by contractor then no liability, otherwise you are principal employer and liable for same.

how ever if the same person is not continued in any 2nd month, then it would be considered as temp worker and would be excluded.

21 September 2012 BUT COMPANY CA SAID ITS NOT APPILICABLE bcz company hired on contract basis and each contractor charged separate bill

21 September 2012 Whatever May be, If You employ For More Than 300 days on Contract basis or payroll, it will be your permanant employee.
