It seems like you are encountering an issue while filing Form 1 for LLP (Limited Liability Partnership) due to the residential status of one of the designated partners not being prefilled. Here are steps you can take to rectify this issue and proceed with the filing:
1. **Check Requirements**: Ensure that the LLP Act's requirement regarding residency of designated partners is correctly interpreted and applied. If one partner is a resident of India and the other is not, it's important to provide the correct details accordingly.
2. **Online Form Filing**: Since you are using an online portal to file Form 1, check if there is an option to manually update the residential status of the partner who is not a resident of India. Sometimes, online forms allow you to manually enter or update information that is not prefilled.
3. **DIN4 Form**: If the portal requires the partner's residential status to be updated using DIN4 (Director Identification Number Form 4), proceed to fill out this form accurately. DIN4 is typically used for updating details of existing partners or directors.
4. **Contact Support**: If you are unable to update the residential status online or through DIN4, contact the support provided by the LLP portal or the Ministry of Corporate Affairs (MCA). They can provide specific guidance on how to correct the error or may assist you in manually updating the information.
5. **Legal Advice**: Consider seeking legal advice or consulting a professional advisor who specializes in LLP filings. They can provide clarity on the legal requirements, assist in navigating the filing process, and ensure compliance with the LLP Act.
**Documentation**: Ensure that you have all necessary documentation and details ready to support the residency status of the designated partners. This includes proofs such as passport copies, residency permits, or any other documents required by the LLP Act.
By following these steps and ensuring accurate information is provided, you should be able to rectify the error related to the residential status of the partner and proceed with the filing of Form 1 for your LLP smoothly.
