Vide notification no. G. S. R. 352(E) Central Government published the Investor Education and Protection Fund (Uploading of information regarding unpaid and unclaimed amounts lying with the companies) Rules, 2012. As per the notification every Company (including NBFC) has to identify the unclaimed amounts referred in Section 205C (2) of the Act.
May please anyone clarify that whether Listed Company/ Public Limited Company/ Private Limited Company/ NBFC not declaring any dividend in any of its years of existence are compulsorily required to upload e-Form 5-INV or not?
Please treat this query as urgent as the last date for the financial year 31st March, 2011 is 31st of this month.
Every Company needs to furnish the following details of unclaimed and unpaid amounts for the year ended 31.03.2011 on or before 31.07.2012:-
(a) *Amount of Unclaimed and unpaid dividend (b) *Amount of application moneys received and due for refund (c) *Amount of matured deposits (d) *Amount of matured debentures (e) Interest accrued on the amounts referred to in clause (a) to (d) above (i) *Unpaid dividend (ii) *Application money due for refund (iii) *Matured deposit with companies (iv) *Matured debentures with companies Total *

You have to file eForm 5INV though company has not declare any dividend so far. It is because Investor education and protection fund is credited not only with unclaimed or unpaid amount of dividend only. As you have mentioned Investor education fund is credited with application money received due for refund, matured deposit & debentures with companies etc.
So if you are falling in any of the said things you have to file e-Form 5INV.
