Double taxation query

20 September 2011 Hello Team,
By reading I understood status criteria (Indian Resident) however not clear on taxation. it would be great if you clarify me.

I am travelling to Canada in Oct 2011. I was outside india for one month in Jan 2011 however was getting indian salary. Apart from this one month no on-site travel in last 4 years.

In this case, do I have to pay income tax on abroad income for period of Oct 11 to Mar 12? If yes, can I get tax exemption in India as I have to pay tax in that country as well.

Please advice as your advice will really help me in taking decision of travel.

22 September 2011 If the stay doesn't exceed 183 days and the salary is paid by Indian Company then there is no tax implication in Canada.

22 September 2011 Hello Anuj,Thanks for an information.

I would like to add that my stay in India will be more than 183 days in India as I am travelling in mid Oct and I am considering 1 month as well because at that time I was on india payroll. However after mid Oct, I will be on Canada payroll. I have to pay tax in Canada for that period.

In this case do I have to pay tax in India on Canada earnings as well for FY 11-12?


22 September 2011 In Jan I was outside India for 28 days however Indian salary was continue. Should I count these 28 days in 183 or not?

22 September 2011 Indian Tax year starts from 1st April and not from January.

Also since you shall be liable to tax in India and Canada but shall get credit for taxes paid in canada.
