if a forgein agency refer patients to an indian hospital??

then
what is applicablity of tds , service tax and double taxation aggrement???

in my case
a forgein agency is refering forgein patients to an indian hosrital & hospital is paying commision to thal agency

now i want to know aplicability of double taxation avoidance aggrement
& tds deduction
