17 December 2013 Can both husband and wife claim deduction U/s.80DD in respect of their mentally retarded child ?

17 December 2013 Hi,

Its S/80DDB, & only parent who has certificate from Dr. can claim deduction.

Thank you for your reply. Still my question is not answered. I have perused your thread as above, I am not finding the answer to my question.

Section 80DD can be claimed whether they spend expenditure or not, it can be claimed on the basis of doctors certificate.

The specific question is, whether the husband and wife can both claim Rs.50,000/- or 1,00,000/- as the case may be, each in their respective returns in respect of mental disability of their child ?

I request you once again look into this and reply, for which I will be gratefull. Thank you.

Please note correction:

The disabled person should be wholly or mainly dependant on you for his / her support and maintenance, and should not have claimed deduction under section 80U.

So only one person can claim deduction.
