Core field amendment

This query is : Resolved

27 April 2021 Sir I applied for core field amendment for inserting additional place of business. But failed to submit clarification within time and the status is pending for order. Is there any time limit for cancellation of amendment application by the officer? He didnt yet passed any order and informed us to send an email requesting to cancel that application. Is that required as per law? I think it is the responsibility of officer to cancel the application if no clarification is filed by the client. Please guide me as per act and rules

06 July 2024 In situations like yours, where an application for amendment (such as inserting additional places of business) is pending due to failure to submit required clarifications within the stipulated time, here are the key points to consider based on company law procedures:

### Responsibilities and Actions:

1. **Officer's Role:**
- The officer handling the application typically has the responsibility to review the application and associated documents, request clarifications if necessary, and take appropriate actions based on the responses received.

2. **Time Limit for Cancellation:**
- The Companies Act and related rules do not specify a specific time limit within which an officer must cancel an application if no clarification is filed by the client. However, officers are expected to proceed with applications in a timely manner and follow due process.

3. **Communication from the Officer:**
- If the officer has requested you to send an email requesting cancellation of the application, it is advisable to comply with this request. This helps in clarifying your intention and ensures that the officer is aware of your decision.

4. **Legal Perspective:**
- From a legal perspective, while it might be the officer's duty to manage applications, proactive communication from your end can help avoid any delays or misunderstandings in the process.

### Practical Steps:

- **Send Confirmation Email:** Send an email to the officer confirming your request to cancel the application for the amendment. Clearly state the application details and reasons for cancellation (in this case, failure to submit clarifications within the required time).

- **Follow Up:** After sending the email, follow up with the officer to ensure they acknowledge and process your request for cancellation. This helps in maintaining a clear record of communications regarding the application status.

- **Future Actions:** If necessary, you can reapply for the amendment once you have gathered all required clarifications and documentation, ensuring compliance with the officer's requirements.

### Conclusion:

While the Companies Act does not mandate a specific time limit for cancellation of an application by the officer due to lack of clarifications, it is important to communicate your intentions clearly to facilitate smooth processing of applications. By sending the requested email for cancellation, you demonstrate proactive engagement in managing the application process effectively.
