Contracts before incorporation

This query is : Resolved

16 June 2009 Dear all

Can contracts before incorporation be enforced against the Company?

16 June 2009 Hi,
The pre-incorporation contracts are valid if
> The contract is made for the purpose of the Company and the Contract is warranted by terms of incorporation
and
> All the contracts prior to incorporation must be adopted by company on its incorporation.

16 June 2009 Agree.

Specific adoption of pre incorporation contracts by company on its incorporation is mandatory in order to enforce them.
