Hi, Yesterday (04/04/2013) I logged in https://incometaxindiaefiling.gov.in and check my status under View Returns/Forms, , I saw suddenly below things uploaded. This was not there in my website till 31-03-2013. A.Y PAN Filed On ITR/Form Type ACK no. Status 2008-09 xxxxx 24/07/08 ITR1 Original xxx Return Uploaded Now I am confused? What does it mean? I have used some consultant to file this return FY2007-08(AY-08-09). I have checked and cannot find any hard copy of Acknowledgement stamped by Government (As those days there was no concept of sending it to CPC, it used to get stamped from IT department manually) My doubt came when I saw status “Return Uploaded”, ideally it should be “ITR processed”. But as those days there was no concept of sending to CPC, Bangalore. I am not sure what does this status means?
Please suggest what shall I do now? Please answer my query one by one, 1. Status “Return uploaded” does it mean, I have not filed the return to income tax department? Consultant (from whom I approached to file the return) only uploaded in to the system and did not do stamping from IT department? 2. Shall I download ITRV from https://incometaxindiaefiling.gov.in system and try to file it’s again? Means visit IT department and get it stamped? 3. Will they (IT department) accept this? If so do I need to pay any fine for this?

The answers to your query are as follows:-
1. First of all find out whether the return was filed online or in manual mode. Then if the return is filed manually then check whether the return acknowledgement bear the stamp of income tax department. If it does bear the stamp then that means that the return has been submitted to the respective department. The status 'Return Uploaded' normally means that the return has just been uploaded and is not yet processed. one more thing is that in case the return is filed manually then the website cannot show that the return has been uploaded because the ITR status can be found out online only when the return is filed online.
2. You can not file the ITR again as the maximum time limit allowed to submit ITR has expired. You also cannot submit the ITR-V of the same return as the period of 120 days must have expired since the date of filing ITR.
3. You need to approach the Concerned Assessing Officer's Office for finding you the status of your Return and before that nothing can be said regarding the imposition of penalty or interest. This will depend upon how the ITR has been or is being processed by the Income Tax Department.

ALso to mention, there was no tax liability. Still do i need to pay interest or penality? all the tax were paid ontime (TDS was deducted by employer and paid to goverment on time) only confusion is wheather its return or not?

It is as simple as that if No tax remained payable at the time of filing the ITR then you need not worry about any interest or penalty. Again i would advise you to approach your assessing officer and find out the processing status of your return. In the income tax department efiling website you can also check whether any outstanding demand is there in any assessment year.
