19 July 2014 We have not mentioned cin no in letter heads and bills for the last months.Is there any option to waive the penalty?

19 July 2014 First rectified that mistake.
I mean update your letter heads etc. with desired information. Further in case you received nay notice from the ROC, than simply say that this was an unintentional error and now we are fully compliant with section 12 of the CA 2013. So kindly condone the default.

19 July 2014 Penalty under section 12(8) is not much keeping in view the heavy penalty prescribed in other Sections of Companies Act, 2013.

Nothing to worry Suchets as it would be difficult to receive notice from ROC for this purpose but later on you may receive notice as default is there. So it is better to rectified that error and be ready for reply in future. In future use proper latter head and other stationary as per section 12(3)(c). I am hopeful that you won’t get any notice as there are various companies which are making this default.

Yes they have the power to waive the penalty and this waiver is dependent on the fact that you are not making continuing default and earlier default was unintentional.
