Co-operative housing society related query

This query is : Resolved

16 October 2013 Hi, I have purchased a flat I havent physically moved in from April 2013.The society is already registered .The flat is being owned by me,My wife and my father jointly .The first owner is myself. I have submitted all my relevants documents pertaining to the purchase of the said flat to the society 3 months back including the membership amount.I have been paying my maintenance bill from Jan 2013 and have paid till March 2013. Even after 3 months the society havent yet included my name in the maintenance bill and it is still been issued in the name of the seller of the flat . I have spoken to the secretary of the society in this regard and as per them I have to wait till the AGM meeting to have my transfer executed including the name in the maintenance bill which I strongly opposed since as per my knowledge its the rightfull duty of the society to immediately get the name of the the present owner included in the maintenance bill and it need not have to wait till the AGM meet.

Kindly advice on the actual law in this regard .

17 October 2013 Hi

Unless Transfer has completed Bills can not be raised in your name.

It is completely depended on bylwas of society.

Thanks//VaibhavJ

17 October 2013 You need to show him the evidence of transfer done in your name via sale deed or agreement made during the time you purchased and also show him the cheque payment made to the seller by you and make an application to the secretary of the society.
