Can a construction company (involved in road construction)claim input vat regarding purchase of capital goods (Purchase of JCB Machine)?

Under DVAT Act
A Construction company (involved in road construction)can not claim input vat regarding purchase of capital goods (Purchase of JCB Machine)
beacuse Input Credit Available only to the Manfacturing Units/Companies.
