Cenvat on addtional duty u/s 3(5)

20 October 2011 i am trader and registered under vat in gujarat. i am importing goods from china and when i am importing addtional duty is levid u/s 3(5) at 4%. can i take credit of it and claim refund? plz. reply as early as possible ..
