SIR, WE ARE PURCHASING RAW MATERIALS BUT RECEIVING INVOICE DUTY INCLUDING AMOUNT. MAY WE TAKE CREDIT THE DUTY PAID BY EXCLUDE FROM THE VALUE?

if you receive goods under cover of "cenvatable invoice" then surely you can do it, in absence of such invoice, its not possible to either take cenvat credit, or to bifurcate the duty amount from purchase.
