Can ca ask stipend back???

22 August 2013 Plz sir/ Madam

Help me. I hv dispute between me & my CA. now i want to termination my article ship from their.. but Now my CA is not allowed me for termination.CA give me a Stipend of RS 3000/- p.m. now she told me that as per rules of ICAI stipend is RS 1,000/- . first you should pay me the Excess of 2,000/-p.m (from star of article to till date).

Plz help me....

22 August 2013 1)your principal stand was not fair

2)whatever be the minimum stipend prescribed by icai generally CA'S will give more stipend than that
.
.
in city like bangalore...generally we can get 5-8 thousand as stipend

3)request your boss that you cannot work for lessthan 3000,,and if it is not possible ask to give transfer of articleship

because if she is so much particular about icai rules,,she will create problems to you there after ,,

however if you say there is good exposure in present firm and cannot get articles in other firm...compromise for stipend and work under her,,accepting to her terms

22 August 2013 i dont think ca can ask for refund.. of stipend.. i think u shd tell her tht its she who have violated the rules n not u.. so u are not liable to refund her extra stipend paid by her..

22 August 2013 dont try to have a heated spech with your boss even though she is wrong she can make problem to you

better speak with her politely,,requestingly and deside whether to continue or other wise request to take transfer

she have all right from not allowing to transfer..so just request and get out of firm

dont try to make any demands--it may harm you..instead you can make polite requests

I will suggest you to, demand from your principal that why I refund you stipend, because there is no provision of refund in CA Regulation.

Any amount which is goes to your bank account from your principal is called stipend.

You can says that the amount you are talking of Rs. 1000/- is a minimum stipend a principal will give.

So you demand a written letter from your principal about refund of stipend.
