15 April 2013 What will be my attmept if I join my articleship from 1st may??

15 April 2013 For which course you are asking is it for IPCC direct entry scheme and asking for IPCC exam or you asking for CA final attempt.

15 April 2013 If you asking about IPCC then May 2014 is the eligible attempt if you started your articleship on 1-5-2013.

If you asking about CA Final then May 2016 will be the your eligible attempt if you started your articleship on 1-5-2013. In case if you started your articleship on or before 30-4-2013 then November 2015 attempt CA final eligible.

As per Regulation 50 of the CA Regulations, 1988, a student will be eligible to appear in Final Exam, after completing of 30 months (2 Years and 6 months) of article ship.

As per this you will be eligible for Nov 2015 attempt. If you register on May 1, 2013.

15 April 2013 To get the eligibility for November attempt the two and half year of articleship period shall be completed by 31St October. Thus if the student registered on 1St may he completed two and half years of articleship with less of one day(i.e 2 years 179 days) by 31st October then is he eligible for November attempt.

15 April 2013 Why i asked above doubt; because of exam form also clear containing shall be complete required period of articleship training by 30th April or 31st October it self for the respective attempts of May and November. As per my view also i agreeing with you but just due to the containing of exam form i aksked that.

REGULATION 29C: ADMISSION TO FINAL EXAMINATION

(1) No candidate shall be admitted to the Final Examination unless he has passed:-
(i) the Intermediate (Professional Competence) Examination in its entirety, held under these regulations;
(II) completed the practical training as is required for admission as a member on or before the last day of the month preceding the month in which the examination is held or has been serving the last six months of practical training under Regulation 50 on the first day of the month in which the examination is held.
(III) he produces a certificate to the effect that he has undergone a study course for such period, as on the first day of the month in which examination is held, in such manner as may be decided by the Council from time to time; and
(iv) completed the Advanced Course on Information Technology Training under these regulations for such period and in such manner as may be decided by the Council, from time to time.;

“Provided that a candidate who has passed Professional Education (Examination-II) under the syllabus as decided by the Council under sub-regulation (5) of regulation 28B and has completed the practical training as is required for admission as a member on or before the last day of the month preceding the month in which the examination is held or has been serving the last twelve months of practical training including excess leave, if any, on the first day of the month in which the examination is held and has completed the said study course and Advanced Course on Information Technology Training, shall be admitted to the Final Examination.”

15 April 2013 Sorry Ajay Mishra sir, I got the logic on this yes, i also agree those who registered on 1st May eligible for November attempt. And those who registered after 1st May not eligible for November attempt.

15 April 2013 And how many leaves can I take in my articleship period.... joining from may 1???

15 April 2013 1/6 of the total period of articleship allowed as maximum leaves.

The eligibility leaves shall be computed as follows.

A) Total no of days XXX
B) Less: Leaves taken XXX
C) A-B XXX
D) Eligible leaves 1/6 * C


Here Total no of days means days from the starting of the articleship period till the date of computation of leaves eligibility on such date.

Leaves taken means actual leaves taken by the student except Saturdays, Sundays and Public holidays which are allowed as holiday to the student by ICAI.


For your under standing following example:

If you started your articleship on 1-5-2013 for the period of 3 years then your articleship period will be completed on 30-4-2016 so on the end of 30-4-2016 you have to compute the excess leaves if any. Thus assume during the articleship period you taken 200 days as leaves excluding Saturdays,Sundays and public holidays(i.e on normal days you taken leave) Then your eligibility leaves is as follows

A) Total no of days (365*3) 1095
B) Less: Leaves taken 200
C) A-B 895
D) Eligibility leaves (1/6*C) 149
E) Excess leaves B-D 51

So you have to do excess period of articleship for 51 days than actual required period of articleship of 3 years.


Thus you get the eligibility on November 2015 you should be in the last six months of articleship period including excess leaves if any on 1-11-2015 so you have to compute your eligibility and excess leaves if any as on 31-10-2015. The computation is in my next reply.

15 April 2013 Now computation of eligibility leaves as on 31-10-2015. Assume you taken leaves from 1-5-2013 to 31-10-2015 is 140

Then

A) Total no of days 913
B) Less: leaves taken 140
C) A-B 773
D) Eligibility leaves 129
E) Excess leaves 11

So on 31-10-2015 you have excess leaves of 11 days so on 31-10-2015 you have remaining period of articleship including excess leaves is 6 months 11 days so you not eligible for November 2015 attempt.

Another example:

Assume you taken leaves of 130 days instead of 140 then

A) total no of days 913
B) Less: Leaves taken 130
C) A-B 783
D) eligible leaves 130
E) Excess leaves 0

So as on 31-10-2015 you didn't have any excess leaves and on 1-11-2015 you are in the last 6 months of articleship training period so you are eligible for November 2015 attempt.

Another example: instead of 130 leaves you taken 120 leaves then

A) total no of days 913
B) Less: Leaves taken 120
C) A-B 793
D) Eligible leaves 132
E) excess leaves if any Nil(-12)

So you didn't have any excess leaves as on 31-10-2015 so eligible for November 2015 attempt.

15 April 2013 So if you joined your articleship on 1-5-2013 then maximum eligible leaves available to you with out post pone of your exam eligibility upto the date of exams commencing month is 130 days.

And during your articleship period you have maximum leaves of 156 without extending of your articleship period.


So you have eligibility maximum of 156 leaves during your articleship period. On this upto eligibility attempt of your exam you have 130 days of leaves to not post pone of your eligibility of attempt.
