Fringe Benefit Tax

Hi,

We are software house and we are in the process of restructuring salaries to reduce tax burden.

One of the ways we will be following is to bring in more reimbursements for employees, which is covered by FBT and not taxable to staff.

The reimbursements are
- Petrol Bills, vehicle Maintenance, Entertainment expenses etc.

My query is
- Can this FBT be recovered from the staff officially (means showing it as part of the salary break up)

Is there any document or deed needed for creation of HUF ?

If car provided by the company to an employee for conveyance , is he eligible for excemption of Rs.9600p.a. from conveyance expenses as per income tax act,1961

CTC Calculation

Hi,

1) Whether Leave salary can be added to CTC or not.

2) What items can be taken for CTC calculation.

transport allowance

if the director is using the company's cars
or
company is providing the car to employee for up and down from resi to office then

can he claim transport allowance of Rs. 9600/-.

Excess Leave during articleship

I am currently doing my industrial training. I had taken excess leave under my previous employer as an article clerk? My industrial training will be completed on 15th April, 2009. As per CA institute regulation i will have to serve excess leave as an article clerk. So i want to know whether i can serve excess leave under my previous employer? What forms do i need to submit for completion of industrial training as well as for registering serving of excess leave? Do i need to file any other form completion of articleship? If yes whether it has to be file now or after completion of serving of excess leave?

TDS DEDUCTION OF RETAINERSHIP FEES

IF THE ADVETRISING AGENCY IS SUBMITING EXEMPTION CERTIFICATE UNDER THE HEAD OF CERTIFICATE U/S 197(1)OF THE IT ACT 1961.
OF DEDUCTING TDS @ 1.133%.
AS PER THE LETTER SUBMITTED FROM AGENCY IT IS STATED THAT
"ASSESSED IN THIS CHARGE IS ENGAGED IN THE BUSINESS OF ADVERTISING & RECEIPTS BEING IN THE NATURE OF ADVERTISING RECEIPTS TDS IS AT THE RATE OF 1.00% & SURCHARGE AS APPLICABLE."

AT WHAT RATE WE HAVE TO DEDUCT TDS ON RETAINERSHIP FEES.IS IT 1.133% OR 11.33%.
